RETURN, REFUND AND EXCHANGE POLICY

All products, we ship outside of Germany and Austria, are non-returnable items. WHEY ORGANIC COSMETICS ® will not pay for refunds. All our cosmetics and food products are natural “organic” products, which, for ecological and sustainability reasons, are usually delivered without sealed outer packaging. They are therefore non-returnable items. For reasons of hygiene, product liability and consumer safety (e.g. possible general contamination, contamination by microorganisms or bacteria, and introduction of harmful substances), our products are generally excluded from return. A refund of the purchase price cannot be made, likewise an exchange of the goods is not possible.


TERMS OF SALES AND SERVICE CURRENCY

We sell only while stocks lasts. We reserve the right to sell goods only in household quantities. All transactions are processed in € EUR (European Euro).

SHIPPING

Goods are shipped by UPS (United Parcel Service of America, www.ups.com) or German Mail (Deutsche Post AG, www.deutschepost.de) or DHL Worldwide (DHL Economy Shipment or DHL Express Shipment (Premium), www.dhl.com). This is tracked and requires usually a signature on delivery. Shipping times are estimated at between 7-14 business days depending on your location (see our Tabular Statement of Shipping Times or wwwapps.ups.com/time, www.deutschepost.de, respectively www.dhl.com).
International customers may be subjected to additional taxes, duties, or tariffs upon delivery. Unfortunately the WHEY ORGANIC COSMETICS ® team has no control on how these local fees are calculated or assigned. WHEY ORGANIC COSMETICS ® is not liable for any additional costs that may be incurred after the item has been shipped. Please consult your local post office for more information.

HOLIDAY DATES

Final orders will be sent out on 20th December - orders need to be placed by 2pm Central European Time (CET) on 19th December to be included in this shipment. Delivery by Christmas Day can not be guaranteed.

Any orders placed AFTER the 20th of December will be sent out beginning 9th January.

WHAT DO WE DO WITH YOUR INFORMATION? When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, email address and telephone number.

When you browse our store, we also automatically receive your computer's internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

1&1 Internet SE (IONOS)

Our store is hosted on 1&1 Internet SE, Germany. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through 1&1’ s data storage, databases and the general 1&1 application. They store your data on a secure server behind a firewall.

PAYMENT

If you choose a direct payment gateway to complete your purchase, then our e-shop stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

The amount, which is to be paid, is debited by credit card. Payable immediately without deduction or discount. The delivered goods remain the property of WHEY ORGANIC COSMETICS R / GLOBAL CONSULTING COMPANY GMBH until complete or legally binding payment. The invoice date is the delivery date.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

1.1 The WHEY ORGANIC COSMETICS online shop is aimed exclusively at consumers. According to § 13 of the German Civil Code, a consumer is a natural person who concludes a legal transaction with a predominant objective that can be attributed neither to his/her commercial activities nor his/her work as a self-employed person. The following General Terms and Conditions apply to all purchase contracts between us, GLOBAL CONSULTING COMPANY GMBH, Business unit WHEY ORGANIC COSMETICS, Post Office Box 1165, 82025 Grünwald, Germany and you as a consumer concluded using the WHEY ORGANIC COSMETICS online shop.

1.2 The present General Terms and Conditions apply to all purchase contracts concluded via the WHEY ORGANIC COSMETICS Online Shop between us, the GLOBAL CONSULTING COMPANY GmbH, Post Office Box 1165, 82025 Grünwald, Germany and you in your capacity as consumer.

2. CONTRACT CONCLUSION; RESERVATIONS

2.1 Upon concluding the order process by activating the "Purchase now" button, you bindingly declare your offer to purchase the goods selected by you (order); we will immediately confirm receipt of the order by e-mail using the e-mail address provided by you. The receipt confirmation is not a binding acceptance of the order; it can however be linked with an explicit acceptance declaration.

2.2 We are entitled to accept the contract offer included in the order within three working days following receipt. We will accept the order by means of an e-mail confirmation or by dispatching the ordered goods. The purchase contract is only concluded by means of this acceptance. We are entitled to reject the order; for example, after checking your credit worthiness. In this case, we will inform you of the rejection in writing or by e-mail.

2.3 We reserve the right to sell goods in common household quantities only.

2.4 We sell while supplies last only.

2.5 After concluding the entry and prior to the binding dispatch of the order by means of activating the "Purchase now" button, all the order details are displayed for you; here, you have the opportunity to correct entry errors.

2.6 The contract text is saved by us and sent to you by e-mail following receipt of your order.

3. PRICES, COSTS AND PAYMENT TERMS

3.1 The price given on the WHEY ORGANIC COSMETICS online shop at the time the order is placed is binding. The price includes the respectively valid VAT, insofar as this applies. No VAT is charged in non-EU countries. In this case, the customs and import duties are borne by the consumer / client.

3.2 A price offered within the context of special offers is exclusively limited to the special campaign. Special campaigns are always indicated as such.

3.3 All prices include the statutory value-added tax. Please note that shipping costs might incur. Information about shipping costs can be found on the product detail pages, during the ordering process.

3.4 Generally, all payment methods displayed during the order process are available. You incur no additional costs for the use of the various payment methods. Please note any bank charges, which may incur for international transfers. The amount may vary depending on the respective bank. The invoice will be sent to the specified e-mail address immediately after order placement.

The following payment methods are available at the WHEY ORGANIC COSMETICS online shop:

  • Instant bank transfer: The invoice amount is transferred from your bank account by online bank transfer at the time of purchase. We will receive a message about the payment process and ship the ordered goods
  • Credit card: You may pay by Visa, Mastercard and American Express.
  • PayPal: During the ordering process, you will be transferred to the website of the online provider PayPal. For this purpose, you need to be registered and logged in at PayPal with your access data.
  • Apple Pay, Google Pay and Ali Pay

Please note that we reserve the right to exclude certain payment methods due to the result of a credit assessment.

3.5 The right of the customer to offset counter-claims shall only exist if these counter-claims are uncontested or have been ascertained to be legally binding. You can only assert the right of retention if your counter-claim is based on the same contract relation.

4. DELIVERY, DELIVERY TIME AND SHIPPING CHARGES

4.1 We deliver within the EU, UK, Norway and Switzerland. For order processing, billing and shipping address must be within the same country.

4.2 You will be informed of the binding period within which we will dispatch the goods in the event of the acceptance of your order (delivery time) during the course of the ordering process. The delivery time begins on the working day following receipt of your order.Versand

4.3 If, for reasons for which you are responsible, the goods cannot be delivered, additional shipping charges will apply in the event of redelivery. In these cases, the shipping and return costs will be borne by you. In the case of a cancellation, Point 7 takes priority.

5. RESERVATION OF PROPRIETARY RIGHTS

5.1 The delivered goods remain our property until full payment of the purchase price.

5.2 Until the transfer of ownership, you must handle the goods with care and keep them in their original packaging.

5.3 You may neither pledge the delivered goods nor assign them as security before the transfer of ownership. In the event of seizure or confiscation or other dispositions by third parties, you shall notify us in advance of in writing without undue delay. You must handle the goods with care until transfer of ownership has taken place.

6. LIABILITY FOR DEFECTS

The valid legal stipulations relating to the liability for defects apply.

7. CANCELLATION RIGHTS AND INSTRUCTIONS

7.1 For private customers and orders from the EU countries (alphabetically) Bulgaria, Estonia, Greece, Croatia, Latvia, Lithuania, Malta, Poland, Romania, Slovakia, Slovenia. Czech Republic, Hungary, Cyprus as well as Norway, Switzerland, UK, USA and Canada we do not grant the right of cancellation, return and exchange. Also, payments made will not be refunded. This is due to complex country-specific customs requirements and customs formalities, transport restrictions and partial undeliverability as well as defective mail transfer from Deutsche Post or DHL to the respective national post office (as provided for in the Universal Postal Treaty or Main Treaty of the Universal Postal Union) as well as partly country-specific taxes and other restrictions on the free movement of goods.

7.2 For private customers and orders from the EU countries (alphabetically) Belgium, Denmark, Finland, France, Ireland, Italy, Luxembourg, Netherlands, Portugal, Sweden, Spain, the right of cancellation, return and exchange applies (see paragraph 7.3 Cancellation Instructions). They have the following right of cancellation.

7.3 CANCELLATION INSTRUCTIONS

Cancellation policy: You have the right to cancel this purchase contract without giving any reasons. The statutory period for revocation/return is 14 days from the date of receipt. The day of receipt is intended as the day on which you or a third party designated by you took possession of the goods.
The deadline is met if you send the goods before the end of the 14 day period. We will check if the returned product complies with the conditions of the return and exchange policy. Incomplete, soiled (e.g. by cosmetics), damaged items or items already worn by the customer or third parties are not returnable, exchangeable or refundable. It is a condition that the product is in a new, unused, unpolluted and flawless condition and that all protective materials as well as intact seal with connecting cord (seal ARGENTO 925 0/00), labels, stickers and original packaging are intact. If this is the case, the refund or exchange will be processed. WHEY ORGANIC COSMETICS does not accept the return of products that show signs of having been worn, used or otherwise altered.

Attention: Stud earrings are generally excluded from exchange for hygienic reasons!

EFFECTS OF CANCELLATION

If you cancel this contract, we will return all payments received from you, including the shipping costs (with the exception of additional costs arising as a result of you choosing a different form of shipping to the standard, less expensive shipping offered by us), immediately and no later than fourteen days from the day on which we receive notification of your cancellation of this contract. For this repayment, we will use the same means of payment as used by you during the original transaction, unless otherwise explicitly agreed with you; under no circumstances will you be charged fees for this repayment. We can refuse repayment until we have received the goods.

You must send back the goods or hand them over to us without undue delay and no later than fourteen days from the day on which you notified us of the cancellation of this contract. The deadline is met if you return the goods prior to the end of the fourteen-day deadline. The direct costs for returning the goods are borne by you. You must only pay for any potential loss in value of the goods if this loss in value is the result of unnecessary handling of the goods caused by checking the composition, properties and function of the goods.

8. APPLICABLE LAW

The law of the Federal Republic of Germany applies (place of jurisdiction Karlsruhe), with the exception of UN purchasing law, which expressively shall not apply.
